1. General
1.1 Al Badr Kunafa AB, org.nr 559114-9116 (“BADR”) sells chocolate products and pastries online through its website albadrkunafa.se (the “Internet Shop”) to consumers as well as to businesses (“Buyer” or “Customer”). A consumer is defined as a natural person who acts mainly for purposes outside the scope of business activities.
1.2 These General Terms and Conditions apply to all orders placed in the Online Shop and to any agreement between you and Al Badr Kunafa relating to the sale of products to you from the Al Badr Kunafa Online Shop (the “Agreement”). Before placing an order, you will be asked to agree to these general terms and conditions. Therefore, please carefully read the terms and conditions and make sure of their meaning before ordering any products from the Internet shop. If you do not agree to the general terms and conditions before placing the order, you will not be able to order any products from the Internet shop.
1.3 These general terms and conditions are valid at all times as written and are subject to change without prior notice to you as Buyer/Customer. It is your responsibility as a Buyer to keep up to date with the latest version of these Terms and Conditions. It is the version of the terms and conditions in force for the time of your order that is applied to the Agreement. These general terms and conditions were last updated on 2025-06-11. Where these general terms and conditions differ depending on whether you are acting as a consumer or as a trader, it is specifically stated.
1.4 By accepting these Terms and Conditions, you certify that you are 18 years of age or older and have the legal capacity to enter into a contract. If you are not a consumer, you confirm by agreeing to these general terms and conditions that you are authorized to enter into contracts for the company/association for which you purchase products in the Internet shop.
1.5 Should any or any of the provisions set out in these Terms and Conditions be or become invalid or impossible to implement in whole or in part, it shall not affect the validity of the other provisions of these Terms and Conditions.
1.6 This paragraph (1.6) applies only to traders. Al Badr Kunafa provides its supplies, services and offers, and enters into contracts exclusively on the basis of these Terms and Conditions. These Terms and Conditions apply to all future agreements between you and Al Badr Kunafa, even if not expressly accepted by you again. These Terms and Conditions and any documents expressly referred to therein constitute the entire agreement between you and Lindt and supersede and void all prior agreements, promises, assurances, warranties, representations and understandings between you and Lindt, whether written or oral and the like. By entering into a Purchase Agreement with Al Badr Kunafa, you acknowledge that you cannot rely on any statement, promise, assurance or warranty (whether or not negligently provided) not set forth in these Terms and Conditions or in any document to which these Terms and Conditions refer.
1.7 The conclusion of the agreement will be documented and stored in our premises. The agreement will not be available to you on our premises.
2. Conclusion of the contract
2.1 The agreement is concluded in Swedish.
2.2 The presentation of products in Al Badr Kunafa's Online Store does not constitute a binding offer by Lindt to perform a purchase agreement.
2.3 After placing products in the “Cart”, you can check them and, if necessary, correct your entire order. Your purchase offer will be executed only after you have pressed “order with an obligation to pay” or a similar button.
2.4 Once you have placed an order in the Online Shop, in addition to the receipt of your order, you will receive an automatically generated e-mail in which Al Badr Kunafa confirms that the order has been received (confirmation of receipt). The confirmation of the receipt does not constitute a confirmation of your offer to purchase. Al Badr Kunafa's confirmation of the receipt also does not imply that a purchase agreement has been entered into between you and Al Badr Kunafa.
2.5 After placing an order in the Online Store, you will also receive a confirmation of your purchase by mail (order confirmation) with information about which goods you purchased and at what price. It is the price stated in the order confirmation that applies to your purchase.
2.6 A Purchase Agreement is entered into only when Al Badr Kunafa expressly accepts the offer to purchase, or when Al Badr Kunafa sends the Products to you without having given you such express acceptance in advance.
2.7 The minimum order value for the delivery of products is 50 SEK per order.
2.8 If Al Badr Kunafa is unable to provide you with a product, for example because the product is out of stock or is no longer available, because Al Badr Kunafa is unable to deliver the item within the desired delivery date, because an item has been incorrectly priced, or because the permitted limit for the number of products per customer has been exceeded in an order, Al Badr Kunafa will inform you of this by e-mail and your orders will not be processed. If you have already paid for the goods, Al Badr Kunafa will refund the full cost of your order, including delivery charge, as soon as possible.
3. Price and delivery fee
3.1 The prices indicated on the product pages of the Online Shop are inclusive of VAT. Delivery fee is stated at checkout.
3.2 Although it is Al Badr Kunafa's intention to always provide correct information on the website, there is a possibility that the products in the Online Shop will be incorrectly priced. In the event that a product has been incorrectly priced, Al Badr Kunafa disclaims responsibility for delivering the product at the incorrect price or at all. In such a case, Al Badr Kunafa will either cancel the order and refund the price you paid or contact you and ask if you wish to complete the order at the correct price. If Al Badr Kunafa is unable to contact you or if you do not wish to complete the order at the correct price, Al Badr Kunafa will cancel your order and refund the price paid to you.
4. Payment terms
4.1 Payment can be made with: Credit cards (MasterCard and Visa); Debit cards (Debit Master card, Visa debit, Maestro, Visa Electron) Klarna and Swish.
4.2 When you pay by credit or debit card, the order amount will be debited from your card upon completion of your order.
4.3 This paragraph (4.3) applies only to consumers. If you have chosen to pay by invoice and have not paid the invoice by the due date, Al Badr Kunafa will charge a reminder fee of SEK 60, as well as an invoicing fee of SEK 45 for paper invoices.If you have not paid for your purchase by the due date of the claim, Al Badr Kunafa may also request compensation from you in the form of default interest of 8% of the amount due per calendar year. This interest shall run on a daily basis from the maturity date until the date on which full payment of the overdue debt is made. The interest must be paid together with the amount due.
4.4 This paragraph (4.4) applies only to traders. If you have not paid for your purchase by the due date of your claim, Al Badr Kunafa may request compensation from you in the form of default interest of 8% of the amount due per calendar year. This interest shall run on a daily basis from the maturity date until the date on which full payment of the overdue debt is made. The interest must be paid together with the amount due.
5. Delivery and delivery time
5.1 The Products will be delivered to the address specified by you in your order, unless otherwise agreed between you and Al Badr Kunafa.
5.2 Delivery is possible within Sweden.
5.3 Once the goods have been delivered to you, you bear the risk of it and you are responsible for keeping it in safe custody.
5.4 Ordered products will be delivered subject to availability. If any product is not available at the time of placing the order, you will be informed of the expected delivery time. As soon as the item is available, it will be sent to you.
5.5 For deliveries within Sweden, the estimated delivery time is between 3-5 working days (excluding Sundays and public holidays) from the time the order confirmation is sent. For customized/custom-made products, delivery time is 10-14 working days. Please refer to Al Badr Kunafa's terms of delivery at https://albadrkunafa.se/policies/shipping-policy for further information.
5.6 If there is a risk that high outdoor temperatures may affect the quality of the products (possible at 23 degrees Celsius or higher), Al Badr Kunafa will inform you of potential delays or temporary interruptions of deliveries in connection with placing your order. When placing your order, you agree that Al Badr Kunafa will ship the products to you only when the temperature has dropped to such a level that the quality of the products is no longer at risk. In such a case, the delivery times specified in paragraph 5.5 above do not apply. Al Badr Kunafa will inform you directly when the products can be shipped again.
5.7 Should an event occur beyond Al Badr Kunafa's reasonable control (known as “force majeure”), it may result in Al Badr Kunafa not being able to perform the delivery within the timeframe specified in paragraph 5.5 above, or at all. In such case, Al Badr Kunafa is not responsible for delayed or cancelled deliveries, if the delay or inability to deliver the goods is due in whole or in part to such an event. Al Badr Kunafa is also not responsible for any subcontractor's delayed or cancelled deliveries, if the subcontractor's inability to deliver in accordance with the contract is due in whole or in part to such event. Such events may include, but are not limited to, accidents, extreme weather, fire, explosions, floods, earthquakes, natural disasters, failures in telecommunications networks, inability to use transport networks, terrorist attacks, war, civil unrest, riots, strikes, lockouts and other industrial disputes, government decisions and the imposition of restrictions on imports or exports.
6th. Portage
6.1 Al Badr Kunafa bears the risk of the goods during transport until the goods have been delivered to the customer. If any item delivered to you has obviously been damaged in transit, please inform the carrier immediately and contact Al Badr Kunafa as soon as possible.
6.2 Your statutory rights are not affected by your failure to notify the carrier or to contact Al Badr Kunafa in accordance with clause 6.1 above. However, you are expected (to a reasonable degree) to assist Al Badr Kunafa with Al Badr Kunafa's potential claims against the carrier and/or relevant insurance company.
7. Proprietary Rights Reservation
7.1 This paragraph (7.1) applies only to consumers. Al Badr Kunafa retains ownership of the products until they are paid in full.
7.2 This paragraph (7.2) applies only to traders.- Al Badr Kunafa retains ownership of the products until all claims that Al Badr Kunafa has on the trader (from the current business relationship) have been paid in full. It is not permitted for the trader to pledge the products or otherwise place them as collateral for any claim before the ownership of them has passed from Al Badr Kunafa to the trader. - Al Badr Kunafa undertakes, at the trader's request, to release Al Badr Kunafa's collateral to the trader, to the extent that the market value of Al Badr Kunafa's collateral exceeds the claims made by Al Badr Kunafa Kunafa has on the trader by more than 10%. Al Badr Kunafa, in such a case, is free to determine what surety should be released.
8. Settlement and right of retention
This section (8) does not apply if you are a consumer.
8.1 The right to set-off of the claim shall exist only if the counterclaim has been established in court and the judgment has become legal, or if the counterclaim has not been contested by Al Badr Kunafa.
8.2 In order to exercise the right of retention, the counterclaim in question must derive from the same contractual relationship as Al Badr Kunafa's claim against the trader under the Agreement.
9. Right of withdrawal
9.1 As a consumer, according to the Act (SFS 2005:59) on distance contracts and agreements outside business premises (the Distance Contracts Act), you have the right to withdraw from the purchase contract within 14 days of receiving the goods. The right means that within 14 days of their purchase, a consumer has the right to cancel the purchase without reason and get the money back. However, according to the Distance Contracts Act, this right of withdrawal does not apply to goods which, due to their nature, cannot be returned or which can deteriorate rapidly, such as food. The right of withdrawal also does not apply to products that have been sealed for health or hygiene reasons and if the seal has been broken by the consumer, or to goods that have been specially manufactured according to the consumer's wishes or otherwise have a distinct personal character.
9.2 The products that Al Badr Kunafa supplies under this Agreement constitute an assortment of various chocolate and pastry products. Since chocolate and pastries are fresh products that can deteriorate quickly, the right of withdrawal under the Distance Contracts Act does not apply. You also do not have the right of withdrawal for products that are sealed and where the seal has been broken by you, or for products that have been specially manufactured for you and have thus acquired a distinct personal touch.
9.3 Notwithstanding the foregoing in clause 9.2, you have the right to withdraw from the Agreement if this right is stated in the Agreement, these general terms and conditions, or (especially if you are a consumer), mandatory legislation. If you wish to withdraw from the Agreement on any of these grounds, you are welcome to use the attached withdrawal form, but it is not necessary to register a return.
10. Right of complaint, guarantees
10.1 This paragraph (10.1), as well as paragraphs 10.2 to 10.5, apply only to consumers. As a consumer, you have a statutory right to receive goods that are not subject to defects. An item is faulty if, for example, it is broken or does not match what has been agreed. This statutory right is not affected by the right of withdrawal described in Section 9 or anything else set out in these Terms and Conditions.
10.2 According to current consumer legislation, you have the right to make a complaint for 3 years from the moment you received the goods. However, in order to claim a defect in the ordered product, you should contact Al Badr Kunafa as soon as possible, but no later than within 2 months from the time you discovered or should have discovered the defect (complaint). If you do not notify Al Badr Kunafa of the error within this deadline, the right to claim is lost. Complaints are made to info@albadrkunafa.se. In the event of a defect in the product, Al Badr Kunafa shall first of all have the opportunity to remedy the defect, for example by sending out a new product to you free of charge.
10.3 Al Badr Kunafa's liability for a defective item is limited to the price of the goods as stated in the Online Shop (including delivery charge and other related charges), as well as any return cost, as long as the defect has not caused harm to the consumer and the damage is due to Al Badr Kunafa's negligence.
10.4 Al Badr Kunafa reserves the right to refuse a complaint if it turns out that the item is not considered to be defective under applicable consumer protection legislation.
10.5 Advice on your rights as a consumer is available, among other things, from the Swedish Consumer Agency. Your statutory consumer rights are not affected by these Terms and Conditions. The home page of the Consumer Agency is https://www.konsumentverket.se/.
10.6 This paragraph (10.6) applies only to traders. For those who are not consumers, Al Badr Kunafa offers a 6-month guarantee from the time the goods are shipped, that the products will be of satisfactory quality and free from material defects. The warranty is offered subject to the following conditions: - After delivery, you must immediately inspect the products and inform Al Badr Kunafa of any obvious or apparent defects within 7 days from the receipt of the order. If the error is hidden, you must inform Al Badr Kunafa about it within 7 days [SR1] from the time you discovered or should have discovered the error. If you do not notify Al Badr Kunafa of the defect within the given time frames, you will be deemed to have accepted the faulty products.- If you inform Al Badr Kunafa of a faulty product within the given time frames, Al Badr Kunafa will choose between rectifying the defect or replacing the defective products, or refunding the full price of the faulty products. After Al Badr Kunafa has taken such action, Al Badr Kunafa no longer has any liability or other liability to you with respect to the defective products.- The warranty offered under clause 9.2 does not apply to defective products if the defect results from: normal wear and tear; wilful damage by the trader; abnormal storage or working conditions; accident; negligence on the part of you or from a third party; your failure device to use or use the Products in accordance with its instructions, or from any alteration or repair of the products carried out by you or by a third party who is not one of Al Badr Kunafa's authorised repairers.
11. Responsibility if you are a company
11.1 This section (11) applies only to traders. Al Badr Kunafa's products are intended to be used internally within your company. By accepting these Terms and Conditions, you confirm that you will not use the Products for any resale purposes.
11.2 Al Badr Kunafa shall have no liability to you for any delay or inability to deliver in accordance with the Agreement, or for any damage or defect in the products delivered under any Agreement, in the case set out above under clause 5.7 (force majeure).
11.3 Nothing in these Terms and Conditions limits or excludes Al Badr Kunafa's liability for:death or personal injury caused by Al Badr Kunafa's gross negligence; fraud or fraudulently providing false information.
11.4 Subject to paragraph 11.2, Al Badr Kunafa shall not under any circumstances be liable to you, whether intra-contractual, non-contractual (including in cases of negligence), as a result of exceeding statutory duty or otherwise, arising under or in connection with the contract, for:loss of profits, sales, business, income or returns; loss of savings; business interruption; loss of production; loss caused by delay or delayed performance; loss of business opportunity; loss of expected savings; loss of goodwill; Or any kind of direct or indirect loss.
I'm 12. Responsibility if you are a consumer
12.1 This section (12) applies only if you are a consumer. If you act as a consumer when ordering or purchasing products in the Online Shop, Al Badr Kunafa is not liable to you (to the extent that Al Badr Kunafa's liability is not regulated by mandatory law) for:loss that is not foreseeable (loss is foreseeable if it was an obvious consequence of Al Badr Kunafa's breach of contract or if the loss was contemplated between you and Al Badr Kunafa at the time of conclusion of the agreement); loss incurred without Al Badr Kunafa having breached the agreement and; business loss (which includes loss of revenue, business, contracts, goodwill, business opportunities, and other similar losses).
12.2 Nothing in these Terms and Conditions limits or excludes Al Badr Kunafa's liability for; death or personal injury caused by Al Badr Kunafa's gross negligence; fraud or fraudulently providing false information.
12.3 As a consumer, you may have special statutory rights in respect of claims arising out of Al Badr Kunafa's negligence or inability to perform in accordance with the contract. Nothing in these Terms and Conditions is intended to limit your statutory rights. For further information about your rights as a consumer, you can contact the Swedish Consumer Agency (see link to their website under section 10.5).
I'm 13. Applicable law and dispute
13.1 Subject to the provisions of clause 14.3 below, Swedish law applies to the Agreement and to any dispute concerning the interpretation or application of the Agreement, as well as to non-contractual and other claims between you and Al Badr Kunafa. Disputes should primarily be resolved in agreement between you and Al Badr Kunafa. In the event that the dispute cannot be resolved by agreement between you and Al Badr Kunafa, you as a consumer have the opportunity to have your case examined free of charge at the General Complaints Board (ARN), Box 174 101 23 Stockholm. Al Badr Kunafa follows ARN's recommendations. Otherwise, disputes or claims arising out of the Agreement, both within and outside the contract, shall be heard by a general court in Sweden.
I'm 14. Other conditions
14.1 You may assign or assign your rights or obligations under any Agreement only if you and Lindt have first agreed in writing.
14.2 No one other than Al Badr Kunafa and the Buyer shall have the right to enforce the Agreement.
14.3 The fact that Al Badr Kunafa does not require you to perform any of your obligations under the Agreement, or that Al Badr Kunafa does not assert its rights against you or delay doing so, does not imply that Al Badr Kunafa has waived its rights with respect to you. It also does not mean that you no longer have to fulfill these obligations. Should Al Badr Kunafa waive any right that Al Badr Kunafa has vis-à-vis you, Al Badr Kunafa will do so in writing, and such waiver does not imply that Al Badr Kunafa has automatically renounced any future right to you.
14.4 Before purchasing a product from Al Badr Kunafa, Al Badr Kunafa asks you to carefully read the list of ingredients of each product you wish to purchase on the Nutrition Information webpage of the Online Shop, if you have any food allergies or intolerances to, for example, nuts or milk. For complete product information as well as date of manufacture and/or best before date please refer to the information on the product packaging.
14.5 Al Badr Kunafa reserves the right to prevent any inaccuracies in the contents of the Internet Shop's website.
14.6 In addition to what is stated in these general terms and conditions, Al Badr Kunafa's privacy policy in force at any time shall also apply to the use of the website www.albadrkunafa.se.
